Layer400 Receiver Software Licence — Personal Use

1. Who we are and what this agreement covers

1.1 The licensor and supplier is Jacques Henry Ireland Steventon trading as Layer400 (the Licensor, Layer400, we, us or our). Email: [email protected] (coming soon). Geographic/postal address: Jacques Steventon trading as Layer400, 11 Wyvern Way, Blandford, Dorset, England, DT11 7XQ.

1.2 This agreement is between the Licensor and the individual consumer whose eligible Layer400 account is used to accept it (the Licensee, you or your). This release is supplied only for your personal, non-business use. It is not available to a company, partnership, public authority, trader acting for business purposes or any person using it wholly or mainly for a trade, business, craft or profession.

1.3 It governs the proprietary Layer400 Receiver software identified in the signed release manifest, its Layer400 updates, documentation and device-side components (the Software). Separately licensed third-party components are governed by their own terms as explained in clause 7.

1.4 This agreement covers the first public personal-use receiver release. It does not authorise business or commercial use, promise professional services or transfer rights under a separate business agreement. The supported installation territory for this release is the United Kingdom. Automatic ground-height estimates cover Great Britain only; elsewhere, enter a measured antenna altitude. Only hardware and operating systems expressly listed for the signed release are supported.

2. When the agreement is made and digital supply begins

2.1 Before download, you will be shown the current versions of this proprietary Software agreement, the separate Contributor Terms, the separate Privacy Notice, the separate Third-Party Notices and the acceptance wording. You must use separate, unchecked controls to:

• accept this agreement;
• accept the Contributor Terms;
• acknowledge that you have read the Privacy Notice;
• expressly request and consent to immediate digital supply; and
• acknowledge the effect that the start of digital supply may have on any applicable cancellation right.

2.2 The agreement is made when Layer400 records your valid acceptance against your verified eligible account. Digital supply begins when delivery of the requested release file actually starts. A failed request that delivers no file does not by itself start digital supply.

2.3 Layer400 will provide a durable acceptance record identifying the account, release, document versions, acceptance wording and time. Keep that record and the complete signed release bundle.

2.4 If consumer cancellation rights apply, clause 18 explains the immediate-supply request and acknowledgement. Nothing in this agreement removes a right before the law permits it to be lost.

3. Eligibility and supported installation

3.1 You may use the Software only while all of the following remain true:

• you are an adult individual acting for personal purposes;
• you use your own verified and enabled Layer400 account;
• the installation is on a supported Raspberry Pi, with a supported operating system and radio adapter, at a fixed station in the United Kingdom that you are authorised to operate;
• the release signature, package checks and hardware checks pass;
• each contributing receiver has its own correctly claimed, unrevoked device identity; and
• you comply with this agreement and the separate Contributor Terms.

3.2 Account limits shown before receiver creation apply. Successful registration alone does not authorise network access or prove that a receiver is listening. A receiver must complete the documented claim, hardware and connection checks. Layer400 may require re-verification after re-imaging, hardware replacement, account recovery or a material station change.

3.3 This release is not a mobile receiver, shared commercial service or managed service for another organisation. Do not describe a supported chipset as approval for every adapter sold under the same brand.

4. Licence grant

4.1 Subject to this agreement, the Licensor grants you a personal, non-exclusive, non-transferable, non-sublicensable licence during the term to:

• download the unmodified signed release through your eligible account;
• install and run it on supported receivers that you own or are authorised to operate and manage through that account;
• keep reasonable backup copies of the unmodified installation and update packages for your own recovery; and
• receive supported openly broadcast radio observations and contribute them from your fixed stations.

4.2 The licence is not a sale or transfer of ownership. It does not permit resale, redistribution of Layer400 proprietary software, operation as a service for another person, or sharing account or device credentials. Third-party licence rights remain separate under clause 7.

4.3 There is no Layer400 software-licence charge for this first personal-use release. You supply the compatible hardware, electricity and internet connection and pay any costs charged by their suppliers. No purchase of professional features or future subscription is required to use this release as described. Any later optional paid service requires a separate clear offer and agreement.

5. Restrictions and lawful exceptions

5.1 Except as this agreement expressly allows, you must not:

• copy, publish, upload, distribute, sell, rent, lease, sublicense or make the proprietary Software or its private debugging material available to another person;
• operate it for another person, as a bureau, shared receiver, managed service or embedded third-party product;
• use it wholly or mainly for a trade, business, craft or profession, for commercial advantage, or on behalf of an organisation;
• copy or reuse a claim code, device private key, certificate or credential on another device;
• bypass or interfere with eligibility, signing, claim, credential, rate, privacy, safety or data-quality controls;
• modify the Software or combine it with other material for redistribution;
• use it to introduce false, simulated, replayed, unlawfully obtained or deliberately misleading production observations;
• remove or obscure proprietary, copyright, licence or security notices; or
• attempt to obtain proprietary source code or private service information from the Software.

5.2 Clause 5.1 does not prohibit an act that applicable law says cannot lawfully be prohibited, including any non-excludable right to observe, study or test the functioning of a program, make a lawful backup, or obtain information necessary to achieve interoperability. Where the law permits Layer400 to require it, you must first request the necessary interoperability information from [email protected] (coming soon), use information obtained only for the permitted purpose, and preserve confidentiality.

5.3 Security research is not authorised merely because the Software is installed. Report suspected vulnerabilities to [email protected] (coming soon). Layer400 may give separate written testing authorisation with defined scope and safeguards.

6. Ownership and confidential material

6.1 The Licensor and its licensors retain all intellectual-property rights in the proprietary Software, Layer400 service, branding, protocols and documentation, except for rights expressly granted in this agreement.

6.2 Private debugging symbols, private build evidence and non-public technical information supplied for support remain confidential. You must protect them with at least the care you use for your own sensitive information, use them only for the authorised support purpose, and delete or return them when Layer400 reasonably asks, unless law requires retention.

6.3 Nothing transfers ownership of your physical Raspberry Pi or other equipment to Layer400.

7. Third-party software and corresponding source

7.1 The release includes third-party components listed in the complete Third-Party Notices and SPDX SBOM supplied with the signed bundle. Those components remain governed by their applicable licences. If a third-party licence gives you broader rights for that component than this agreement gives for the proprietary Software, the third-party licence prevails for that component only.

7.2 The bundle includes complete corresponding source and build instructions for the distributed GPL-licensed dump1090 component. That source bundle contains no Layer400 proprietary receiver source.

7.3 The Software is closed source. No public artifact, support bundle or corresponding-source bundle includes Layer400 proprietary application source, source maps, private repository material or private debugging symbols.

8. Account, claim and device credentials

8.1 Keep your account secure and use only your own verified account. Do not share passwords, session links, claim codes, private keys or device credentials.

8.2 Claim codes are single-use and time-limited. The Pi generates its device private key locally. You must not export or clone that private key except through a recovery method that Layer400 expressly documents and approves.

8.3 Notify [email protected] (coming soon) promptly if the account or device may be compromised. Layer400 may rotate or revoke credentials to protect the account, network or other people.

9. Installation, equipment and lawful operation

9.1 You are responsible for the Pi, radio hardware, antennas, power supply, network, site permission, physical security, ventilation, electrical safety and lawful installation.

9.2 Use only supported hardware and settings. Do not use the Software to intercept private communications, transmit without authority, interfere with radio services, enter a restricted site or evade a legal restriction.

9.3 Keep the station location, antenna information, clock and hardware declaration accurate. Do not publish an identifying home address as a station name.

9.4 Follow signed update and retirement instructions. Before sale, transfer, disposal or reassignment of the Pi, revoke the receiver credential and erase Layer400 identity material using the supported process.

10. Contributions and network data

10.1 Operating a contributing receiver is also governed by the versioned Contributor Terms accepted with this agreement. Those terms describe your authority to contribute observation and station-health data and Layer400's permitted use of that data.

10.2 Do not inject synthetic observations, replay recordings as current reception, or disguise demonstrations as aircraft activity. A genuine over-the-air acceptance transmitter may be used only with separate Layer400 authorisation and must be identified as a test source in the resulting product view. Such a physical reception test does not prove that an aircraft was flying.

10.3 Layer400 may validate, delay, aggregate, quarantine, suppress or discard observations for security, privacy, integrity, capacity or legal reasons. Connection does not guarantee public map publication.

11. Privacy and diagnostics

11.1 The Privacy Notice explains how Layer400 handles account, receiver, station-location, security, support and observation-related personal data. Acknowledging that notice is not consent to unrelated processing and does not replace the lawful basis described in the notice.

11.2 Exact station coordinates and device identifiers are restricted operational data. Public views may use reduced precision, aggregation, delay, pseudonyms or suppression.

11.3 The support-bundle command creates a redacted archive locally and does not upload it automatically. Inspect it before sharing and use only an approved support route. Never add passwords, claims, private keys, raw receiver identity, exact coordinates or unrelated personal files.

12. Updates, compatibility and support

12.1 Layer400 may issue signed security, compatibility or data-quality updates and may set a reasonable deadline for a necessary update. Automatic security and reliability updates are enabled by default for this release. Only a newer, correctly signed, compatible, non-revoked final stable release may install automatically; the receiver rechecks the current signed offer before installation.

While the receiver is powered, online, automatic updates are enabled and safety checks pass, an eligible update is applied within 48 hours of the receiver's first successful check confirming eligibility. A deterministic per-receiver delay staggers installation. After 48 hours without a successful check, including an extended offline period or pause, the normal rollout window starts at the next successful check. A shorter pause retains the existing schedule.

You can pause or resume automatic updates in Updates, or choose manual installation as soon as an eligible update is offered, without waiting for the rollout delay. You can also upload a signed update file. Both online and uploaded updates verify the trusted signature, compatibility and package before installation. An uploaded file does not make an unknown signing key trusted.

The update process preserves receiver identity, confirmed location and configuration, and local history where appropriate. Bounded post-installation health checks run before success is reported. If those checks fail, the updater automatically restores the retained previous known-good version and reports the rollback reason. If recovery cannot complete safely, it reports that owner attention is required. Safety or availability failures can delay an update beyond the normal window; a failed or rolled-back installation is not silently reported as success or automatically retried repeatedly. Pausing updates may leave security or reliability fixes unapplied.

12.2 Layer400 will not silently install an unsigned package. Verify the release signature and checksums. A changed signing key requires an authenticated transition or recovery process.

12.3 Support is provided through the published Layer400 support route on a reasonable-efforts basis. No response time or continuous availability is promised unless separately agreed in writing.

12.4 Layer400 may change or discontinue a service feature for a genuine security, legal, compatibility or operational reason, with reasonable notice where practicable. We will explain any action required to keep a receiver working. We will not use this clause to remove a consumer's non-excludable remedy for digital content already supplied.

13. Suspension and credential revocation

13.1 Layer400 may temporarily isolate the receiver, stop map publication, suspend ingest or revoke a credential where reasonably necessary to:

• address an actual or suspected security compromise;
• prevent unlawful use, material privacy harm, radio interference or danger;
• stop materially false, corrupted, abusive or excessive traffic;
• enforce an eligibility boundary or material breach of this agreement; or
• comply with law or a binding request from a competent authority.

13.2 Where lawful and reasonably practicable, Layer400 will explain the reason and provide a route to correct or challenge the issue. Emergency action may be taken first where delay would materially increase risk.

13.3 Suspension of network access does not erase your local data or transfer ownership of your hardware.

14. Description, quality and remedies

14.1 Layer400 will supply the Software substantially as described in the signed manifest and accompanying release documentation. Supported hardware, capture scope, dependencies and material limitations are stated before acceptance. A feature is not represented as qualified merely because a compatible radio is present.

14.2 Radio reception depends on aircraft broadcasts, terrain, range, interference, antenna placement, hardware and network conditions. The Software cannot detect every aircraft or prove that an area is clear.

14.3 Nothing in this agreement excludes or restricts any statutory guarantee, right or remedy that applies to you and cannot lawfully be excluded or restricted. If the Software is faulty, you may have rights to repair, replacement, price reduction or another remedy depending on the circumstances and applicable law. Contact [email protected] (coming soon).

14.4 To the extent permitted by law and subject to clause 14.3, Layer400 does not promise uninterrupted or error-free operation, reception of every broadcast, compatibility with hardware not expressly approved, or availability of experimental network services at all times.

15. Safety and permitted reliance

15.1 Layer400 Receiver and the Layer400 map are informational community-reception services. They are not air traffic control, an air-traffic service, a navigation aid, a detect-and-avoid system, an emergency service, a law-enforcement system, legal advice or proof that airspace is clear or lawful to enter.

15.2 Do not use them as the sole basis for flight, navigation, emergency, safety, enforcement or confrontation decisions. Use official information and comply with the duties that apply to your activity.

16. Liability

16.1 Nothing in this agreement excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of obligations that cannot lawfully be limited.

16.2 Layer400 is responsible for loss or damage that is a foreseeable result of our breach of this agreement or failure to use reasonable care and skill. Layer400 is not responsible for loss or damage that was not foreseeable, for business loss arising from use that this consumer-only agreement does not permit, or for loss caused by your unlawful use, unsafe installation, unsupported modification or failure to follow clear signed instructions, except where the law says otherwise.

16.3 You remain responsible for backing up your own non-secret configuration information and for the physical equipment and site. This clause does not make you responsible for loss caused by Layer400's breach or negligence.

17. Term and termination

17.1 This agreement begins under clause 2 and continues until terminated.

17.2 You may terminate at any time by stopping the receiver, revoking its credential through your account, uninstalling the Software and deleting unneeded copies, subject to any non-excludable rights and any record-retention duty imposed by law.

17.3 Layer400 may terminate by written notice if you materially breach this agreement and, where the breach can be remedied, do not remedy it within a reasonable period stated in the notice. Layer400 may terminate immediately for deliberate credential theft, malicious network abuse, unlawful interception, dangerous interference or another serious breach that cannot reasonably be remedied.

17.4 On termination, the proprietary licence ends. Stop using the Software, revoke the device credential and delete proprietary copies and private debugging material. Clauses intended by their nature to continue—including ownership, confidentiality, accrued rights, liability and governing law—continue.

18. Consumer cancellation and immediate digital supply

18.1 If the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you a right to cancel this digital-content contract, you request that supply begin immediately rather than waiting until the end of the cancellation period.

18.2 Before supply begins, Layer400 will ask for your express consent to immediate supply and your acknowledgement that you will lose the applicable right to cancel once digital supply begins. The controls will not be pre-selected.

18.3 Your cancellation right is lost only when and to the extent the law provides. This clause does not affect rights concerning faulty, misdescribed or non-conforming digital content.

19. Transfer, changes and general terms

19.1 You may not transfer this agreement or the licence without Layer400's prior written consent. Layer400 may transfer the agreement only to a person who can perform it and without reducing your mandatory rights; we will tell you if that occurs.

19.2 A change to these terms applies to an existing installed release only if you expressly accept the new version where acceptance is legally required. Security or service changes may still be made under clauses 12 and 13 without rewriting the contract.

19.3 If a court finds part of this agreement unlawful or unenforceable, the remaining parts continue to the extent they can fairly do so. A delay in enforcing a right is not a waiver.

19.4 This agreement and the signed release manifest form the contract governing the Layer400 proprietary Software, alongside rights that law implies. The Contributor Terms are a separate agreement governing receiver operation and contributed data. The Privacy Notice is a separate notice explaining personal-data handling and is not itself a request for consent unless it expressly says so. The Third-Party Notices identify separately licensed components and do not grant rights in Layer400 proprietary source code.

19.5 Only you and the Licensor may enforce this agreement, except where applicable law gives another person a right that cannot be excluded.

20. Governing law and jurisdiction

The laws of England and Wales; the courts of England and Wales shall have jurisdiction, subject to any mandatory consumer rights that cannot lawfully be excluded.
